How long will my divorce take?
Even in a straightforward case, you should allow around 16 weeks for the divorce to be finalised. The total time will depend largely on the speed of the court and the ability to agree your divorce with your spouse .

Can I speed the process up by getting a ‘Quickie’ Divorce like celebrities do?
There is no such thing as a Quickie Divorce for celebrities. The process is the same for everyone, and can only really be sped up by agreeing issues such as the consent order amicably with your spouse.

In addition to QuickEasyDivorce.com’s charges, how much will the divorce cost?
You will need to pay total Court fees of at least £380.00. This covers filing the petition, applying for the Decree Absolute and filing your (hopefully) agreed consent order. Additional court fees may be payable however depending on exactly how matters progress.

Help Me! I cannot afford the Court Fees?

If you cannot afford the court fees you may be entitled to apply for ‘fee exemption’ if you are in receipt of:
a) both Child Tax Credit and Working Tax Credit;
b) Jobseekers Allowance; or
c) Income Support.

You will need to complete application form EX160 and the court will give this to you. You will have to provide proof to the court that you are in receipt of benefits. If you are suffering under financial hardship you could apply for ‘fee remission’ if. You would use Form EX160 here as well.

What can I do if my spouse refuses to return the acknowledgment of service after the Petition has been sent?
If you are on speaking terms with your spouse, you could contact them to check that they have received the Petition and ask that he or she returns the acknowledgement of service. If this doesn’t work, you can apply for a Court Bailiff to serve the Petition on your husband/wife. You will need to complete two copies of Form D89 from the court and an additional fee will be payable for this.

I really want to get divorced but I don’t have a clue where my spouse is. What do I do?
You can apply to dispense with service of the petition. However if you are alleging adultery or 2 years separation by consent this option is not available to you and you may wish to seek legal advice.

What is a “Consent Order”?
When both parties agree as to how their property, finances, children and affairs will be separated then will draft a Consent Order. A consent order reflects what you and your spouse have privately agreed to do in relation to your affairs at the end of the divorce. This Consent Order is given to the Court once it has been agreed between the parties is stamped by the Court. Once it has been stamped by the Court its provisions are generally final and binding and can only be changed under very limited circumstances.

What if my spouse starts to cause me problems and does not agree to a consent order?
If you and your spouse cannot agree on how your affairs should be split then the court will have determine this for you. In this case you will need our Platinum service as you will need a lawyer advising you full time on your case and advising you how best to negotiate and strengthen your position.

What is an ‘Affidavit in support of Petition’?
Once your spouse returns the acknowledgment of service and confirms that the divorce won’t be defended, you will need to complete this form to ask that the court approves your ground for divorce. The form will need to be sworn in front of an independent solicitor or a court officer. Please note that an independent solicitor will usually charge a small fee for this service.

What Documents Do I Need to Produce With My Divorce Papers?
You will need to produce your original Marriage Certificate when you lodge your divorce papers in court. If you cannot find your original marriage certificate then need to obtain a replacement certified copy of your marriage certificate from your local Registry of Births Deaths and Marriages. This office will charge you a small fee for this. A court will not accept a photocopy of your marriage certificate in your divorce papers.

My marriage certificate is in a foreign language as I was married abroad. Is this ok?
Yes but the court will require a translation of your marriage certificate. The translation will need to be prepared by professional translators. We can assist you with this if you need help.
